USFILED / THE READING ROOM
US client asks for W-9: which form applies?
The correct form follows the payee’s tax status, not simply the location of the LLC. Ask the preparer to identify who is treated as the payee before signing.
What matters in your case
W-9 is for US persons. A foreign owner of a disregarded entity may need the relevant W-8 form instead; entity classification and the payment matter.
Do not certify US-person status merely because the LLC has an EIN. Bring the client’s request and your ownership records.
